DMCA Policy

Greek Yogurt Dressing ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Greek Yogurt Dressing service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

Filing a Notice of Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Greek Yogurt Dressing Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Greek Yogurt Dressing will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Your DMCA Notice of Alleged Infringement must include substantially the following:

  1. Identify the copyrighted work that you claim has been infringed.
  2. Identify the material or link on the Greek Yogurt Dressing Site that you claim is infringing the copyrighted work and provide the URL(s) or other pertinent information to allow Greek Yogurt Dressing to locate the material.
  3. Provide your mailing address, telephone number, and email address.
  4. Include both of the following statements in the body of the Notice:
    • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).

Filing a Counter-Notification to a DMCA Takedown Notice

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written counter-notification to our Designated Copyright Agent, as described below. Pursuant to the DMCA, the counter-notification must contain substantially the following:

  • Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. (e.g., provide the URL(s) of the content on the Greek Yogurt Dressing Site).
  • Provide your name, mailing address, telephone number, and email address.
  • Include both of the following statements in the body of the Counter-Notification:
    • "I hereby state under penalty of perjury that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
    • "I hereby state that I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Greek Yogurt Dressing may be found, and I will accept service of process from the person who provided the DMCA notification or an agent of such person."
  • Provide your full legal name and your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).

Upon receipt of a valid counter-notification, we will promptly provide the complaining party with a copy of the counter-notification. The complaining party will then have 10 to 14 business days to inform us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Greek Yogurt Dressing Site. If we receive no such notification within 10 to 14 business days, we may, in our sole discretion, restore the material.
